The patent must be filed in Patent Office by all the inventors to be the ownership for their inventions. The administrators in the office will grant the patent if it comply all the rule and regulations of the patent office. In United States, the USPTO was operated by US congress and handed over to Department Of Commerce. Department of Commerce lays all the rules and regulations of the PTO.
In US patent office was established for over 200 years, the basic role of the USPTO has remained the same: to promote the progress of science and the useful arts by securing for limited times to inventors the exclusive right to their respective discoveries (Article 1, Section 8 of the United States Constitution). Under this system of protection, American industry has flourished. New products have been invented, new uses for old ones discovered, and employment opportunities created for millions of Americans. The strength and vitality of the U.S. economy depends directly on effective mechanisms that protect new ideas and investments in innovation and creativity. The continued demand for PT underscores the ingenuity of American inventors and entrepreneurs. The USPTO is at the cutting edge of the Nation’s technological progress and achievement.
Congress established the USPTO to issue patents on behalf of the government. The office as distinct bureau dates from the year 1802 when a separate official in the department of state who became known as “superintendent of patents” was placed in charge of it. The revision of laws enacted in 1836 reorganized PTO and designated the official in charge as commissioner of patents. In 1925 it was transferred to the Department of Commerce where it is today. The name of the office was changed to the PTO in 2000. The USA USPTO information is open to all public and available in USPTO patent homepage.
The Office supplies copies of it and official records to the public. It provides training to practitioners as per the requirements of statutes and regulations, and publishes the MEPE to elucidate these. Similar functions are performed relating to trademarks. The USPTO also disseminates that and trademark information that promotes an understanding of Intellectual property protection and facilitates the development and sharing of new technologies worldwide.
European patent office: the European Law, grants patents: a system of law, common to the contracting states, for the grant of it for invention is hereby established. It is granted by virtue of this convention shall be called European patents. It shall, in each of the contracting states for which it is granted, have the effect of and be subject to the same conditions as a national granted by that state, unless otherwise provided in this convention. An EPO, hereinafter referred to as the organization, is established by this convention. It shall have administrative and financial autonomy.
The official languages of the EPO shall be English, French and German. These applications must be filed in one of these languages. However, natural or legal persons have their residence or principal place of business within the territory of a Contracting State having a language other than English, French or German as an official language, and nationals of that State who are resident abroad, may file the applications in an official language of that State. Nevertheless, a translation in one of the official languages of the EPO must be filed within the time limit prescribed in the implementing regulations; throughout the proceedings before the EPO, such translation may be brought into conformity with the original text of the application.

European patent is used to refer to patents granted under the European Patent Convention.

The European patent convention provides a legal framework for the granting of European patents, via a single, harmonized procedure before the European Patent Office. A single patent application in one language, may be filed at the European Patent Office at Munich, at its branches at The Hague or Berlin at a national patent office of a Contracting State, if the national law of the State so permits.

European patent applications may be filed in any official language of an EPC contracting state but patent applications are prosecuted in the three official languages of the EPO – English, French and German (if an application is filed in a language other than the official languages, a translation must be filed into one of the three. The filing fee is reduced to offset the additional cost of the translation). The official language of filing (or of the translation) is adopted as the “language of proceedings” and is used by the EPO for communications.

The European Patent Organization (EPO) is continuing to grant thousands of monopolies on “computer-implemented” algorithms and business methods every year.

A European patent is also non-unitary in that it may be revoked in one Contracting State while maintained in another. However, a national court in one Contracting State may not revoke a European patent in another Contracting State.
