A patent attorney is personnel with basic law degree and has a wide knowledge about patents and related technologies. Patent prosecution can be split into pre-grant prosecution and post grant prosecution, pre-grant prosecution involves in negotiation with a patent office for the grant of a patent, and post-grant prosecution involves in the issues such as post-grant amendment and opposition.


Patent prosecution can be distinguished from litigation, which describes legal action related to the infringement. Pre-grant prosecution ; to obtain patent rights for an inventor, the practitioner first drafts an application typically by questioning the inventor to understand the nature of the invention and helping them clarify novel features , and to obtain drawings and written notes regarding the features of the invention and its background.

During patent drafting, the practitioner may also seek to find out whether any publications, offers for sale, or other such public disclosures of the invention were made. Even in other jurisdictions, early filing may prevent the use of certain materials from being applied against the application as prior art while the application is pending before the PTO.

Search and examination is the principle part of the prosecution of a patent application leading to grant. A search is conducted by the PTO for any prior art that is relevant to the application in question and the results of that search are notified to the Applicant in a search report. The examiner who is conducting the search indicates what aspect the documents cited is relevant (novelty, inventive step, background) and to what claims they are relevant. The materials searched vary depending on the PTO conducting the search, but principally cover all published applications and technical publications. The search report is typically published with the application, 18 months after the earliest priority date.


If the Examiner finds that the application does not comply with any requirements an examination report is issued drawing the Examiner’s objections to the attention of the Applicant and requesting that they be addressed. The Applicant may respond to the objections arguing in support of the application, and/or making amendments to the application to bring it in to conformity. Alternatively, if the Examiner’s objections are valid and cannot be overcome, the application may be abandoned.

We are open to suggestions from clients for a regular monthly retainer fee arrangement where the client agrees to retain us for a minimum period of one year to provide our services. We provide a search report which is customized to meet the requirements of each client and our standard report meets most of the normal requirements. A good agent has curiosity about the way things work and the ability to understand technical concepts, processes, and apparatus. They must be an excellent communicator, both verbally and in writing. They could be able to explain the rules for patentability and procedures for obtaining an ownership to the inventor or owner of the invention. They could be able to write a description of the invention that will enable others to use the invention, and write claims to the invention that communicate clearly what it is that the public is excluded from making, using, or selling without permission from the holder of the patent.
Many jobs are in cities like Washington, D.C., where the USPTO is located, and cities such as New York, Chicago, Los Angeles, and San Francisco, where many large corporate headquarters are located. A good number of jobs are in these departments of the largest corporations with research and development departments in the towns and cities where the research and development facilities are located.These agents most often work for a law firm or a corporation or enterprise that has research and development activities resulting in inventions or that purchases rights to inventions. A small number of agents have been hired by national laboratories where research is taking place. Other agents are self-employed and seek inventors or businesses or investors who desire patents. These agents may go to meetings of inventors’ clubs and entrepreneurial organizations, give talks on how to get patents on an invention, and get referrals from attorneys and business people who deal with inventors and small businesses. Most of a these agent’s professional life is spent reading, writing, and talking with inventors, owners of inventions, and examiners employed by the USPTO.

An International patent application shall be filed in the Patent Office which would process the application in accordance with these rules and the provision under the PCT. Provided it complies with the minimum requirements for obtaining an international filing date, your international application has the effect of a national patent application in those PCT Contracting States which you have “designated” in your application.

It has the effect of a regional patent application in those PCT Contracting States which are also party to a regional patent treaty (the ARIPO Harare Protocol, the Eurasian Patent Convention, the European Patent Convention and the OAPI Agreement), provided they are designated for the regional patent concerned. (It should be noted that, for some of these States, only a regional patent can be obtained via the PCT.)

Because an international patent application must be prepared in accordance with certain requirements set out in the Treaty and Regulations, which have become international standards effective in all of the PCT Contracting States, subsequent adaptation to varying national (or regional) formal requirements ( and the cost associated therewith) will not be necessary.

The granting of a patent remains the responsibility of the national or regional Offices but the start of the processing of the application before those Offices (the “national phase” or “regional phase”), including examination as to substance, is generally delayed until after the end of the 30th month from the priority date.

An International patent application designating India shall be treated as an application for patent under the Act. The advantages that are offered by filing an“international” patent application under the Patent Cooperation Treaty (the “PCT”). By filing one international patent application under the PCT, and designating any or all of the PCT Contracting States, you can simultaneously seek patent protection for an invention in each of a large number of countries.
